Trainer Terms - The Basics

Welcome to the TRAINMORE platform. These Trainer Terms ("Terms") govern your relationship with TRAINMORE as a trainer, and they are part of our broader Terms of Use.
By becoming a trainer on our platform, you agree to these Terms, which explain your rights and obligations. Any capitalized terms not defined here are as specified in our Terms of Use. When you create and offer fitness programs, you are contracting directly with TRAINMORE, and not with any clients. Please read these terms carefully before posting and selling content on the platform.
1. Trainer Obligations
As a trainer on the TRAINMORE platform, you are responsible for all content that you submit, including workout programs, videos, images, descriptions, and any other materials ("Submitted Content"). By submitting content, you warrant that:

You will provide accurate account information and keep it updated.

You have the necessary rights, licenses, and authority to post and sell your Submitted Content on our platform.

Your Submitted Content will not infringe any third-party rights, including intellectual property rights.

You have the qualifications, certifications, or expertise to offer the services provided.

You will comply with all relevant laws and ensure that your services meet the industry standards.
You also agree not to:

Post any offensive, inappropriate, or misleading content.

Engage in spamming, unauthorized advertising, or solicitation of other users.

Impersonate another person or misrepresent your affiliation with the platform.

Interfere with the content or services of other trainers.

Circumvent the platform’s security or payment systems.
2. License to TRAINMORE
By submitting content to the platform, you grant TRAINMORE a worldwide, non-exclusive right to market, distribute, and promote your content on the platform. This includes the right to sublicense your content to clients and third-party partners for promotional purposes.
You also authorize TRAINMORE to use your name, image, and likeness for marketing and promoting the platform and your Submitted Content. You may remove your content from the platform at any time, but the rights granted to clients prior to removal will continue, and TRAINMORE may continue using your content for promotional purposes for up to 60 days after removal.
3. Payment Terms
3.1 Revenue Share
When a client purchases your content, TRAINMORE will deduct applicable fees, including a 20% platform commission and any transaction processing fees (e.g., Apple or Stripe fees). The remainder (net revenue) will be divided as follows:

TRAINMORE Fee: TRAINMORE retains a 20% platform commission from the original price, regardless of the platform.

Apple Fees:

Using stripe within the EU: Apple charges a 12% fee.

In-App Purchases outside the EU: Apple charges a 15% fee.

Web-Based Purchases: No additional transaction fees apply for web-based purchases beyond the TRAINMORE platform commission.
3.2 Payout Schedule
Trainer payments will be made on a 45-day delay after the end of the month in which the sale was made, to account for refunds, disputes, and platform fees. For example, if a sale occurs in January, the payout will be issued by mid-March. Payments will be made via Stripe Connect, and you must have a valid Stripe account to receive your earnings.
3.3 Refunds
You acknowledge that clients may request refunds in accordance with our Refund Policy. If a refund is issued, you will not receive payment for the refunded transaction. If a refund is processed after you have already been paid, the refunded amount will be deducted from your next payment.
3.4 Transaction Taxes
TRAINMORE will handle any applicable transaction taxes (such as VAT) in accordance with local laws. For in-app purchases processed via mobile platforms (Apple, Google), the platform will handle and remit the necessary taxes.
4. Content Guidelines and Standards
You agree to comply with all content standards and guidelines established by TRAINMORE. Your Submitted Content must be of high quality, clear, and relevant to the fitness programs you offer. TRAINMORE reserves the right to review, modify, or remove any content that does not meet these standards or that violates any terms outlined here or in the Terms of Use.
5. Trust and Safety
TRAINMORE prioritizes a safe and respectful environment for both trainers and clients. We reserve the right to suspend or terminate your account, remove content, or withhold payments if we find that:

You violate these Trainer Terms or any other policies.

Your content falls below our quality standards.

Your behavior negatively impacts the platform or community.
6. Intellectual Property
You retain ownership of the intellectual property rights in the content you create. By submitting content to the platform, you grant TRAINMORE a limited, non-exclusive license to use, distribute, and display your content in accordance with these Terms.
7. Payout Methods and Conditions
You are responsible for ensuring that your Stripe account is valid and in good standing to receive payouts. Any changes to your payment information must be updated promptly. TRAINMORE reserves the right to withhold or delay payments in the event of account irregularities or incomplete tax documentation.
8. Termination
You may terminate your account at any time by contacting TRAINMORE support. Upon termination, any remaining payments owed to you will be processed in accordance with the existing payout schedule. Your Submitted Content may remain accessible to clients who have already purchased it, even after your account is deleted.
9. Miscellaneous
Updates to Terms:
TRAINMORE reserves the right to update these Terms at any time. We will notify you of any significant changes via email or through the platform.
Legal Relationship:
These Terms do not create a partnership, agency, or employment relationship between you and TRAINMORE.
